How Workers Can Respond to Increased Use of Generative Artificial Intelligence

Recent advances in generative Artificial Intelligence (AI) have generated a media buzz and revived worries about the future of work: How many jobs are at risk of being eliminated? Can workers be retrained to work new jobs that did not exist before, or new versions of their now technologically-augmented jobs? What happens to those workers who cannot be retrained? What if not enough jobs are created to compensate for those lost?

It is hard to calculate the pace, extent, and distribution of job displacement due to technological advancements.[1] However, there is general agreement among business leaders that there will be significant job losses due to AI.[2] Professions spanning the education and income spectrum may be impacted, from surgeons to investment bankers to voice actors.[3]

Nevertheless, the jobs predicted to be most impacted are lower-paid jobs such as bank tellers, postal service clerks, cashiers, data entry clerks, and secretaries.[4]

Proponents of rapid AI adoption emphasize its potential for creating “a productivity boost for non-displaced workers” and a resultant “labor productivity boom.”[5] While that will likely be true, what remains uncertain is who will reap the majority of the benefits stemming from this boom — employers or their now more productive workers.

One of the main concerns about increasing use of AI in the workplace is that entire job classifications will be eliminated, leaving large swaths of workers unemployed. There is no consensus over whether technology has created or eliminated more jobs.[6] However, even assuming technological advances have created more jobs than those rendered obsolete, the process of large numbers of workers switching from one type of job to another (perhaps previously nonexistent) job still creates serious challenges.

For one, this process adds stress on an already economically- and emotionally-stressed population.[7] The Center for Disease Control credits “fears about limited employment opportunities, perceptions of job insecurity, and anxiety about the need to acquire new skills” as contributing to “public health crises such as widespread increases in depression, suicide, and alcohol and drug abuse (including opioid-related deaths).”[8] Those workers able to keep their jobs have less bargaining power, as they fear speaking up about possible health, safety, and other concerns for fear of losing their job.[9]

To assist in this transition, some argue that more government intervention is necessary.[10] In fact, several states have enacted legislation regulating the use of AI in employment matters, including protections against discrimination in employment decisions made using AI.[11] Some states are also experimenting with AI training for high school seniors and state employees, sometimes with encouragement from major employers.[12] Federal politicians are also considering legislation, although none has passed.[13]

Some commentators argue that workers themselves have a responsibility to learn skills to remain competitive in the labor market.[14] Still others argue that employers should take up the task of retraining employees, with benefits for employers including ensuring an adequate supply of skilled labor, reducing hiring costs, and increasing employee loyalty, morale, and productivity.[15] One subset of this approach are partnerships between employers and labor unions, such as that between Microsoft Corp. and the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO).[16] Announced in December of 2023, the partnership lists its goals as (1) sharing information about AI trends with unions and workers, (2) integrating worker feedback into AI development, and 3) influencing public policy in support of affected workers.

Others point to the need for strong worker organizations that are capable of bargaining about and achieving protections related to AI and other technology in the workplace.

Collective Bargaining

The Economic Policy Institute, a think-tank aligned with labor unions, argues that the “best ‘AI policy’ that [policymakers] can provide is boosting workers’ power by improving social insurance systems, removing barriers to organizing unions, and sustaining lower rates of unemployment.”[17] Union officials agree on the importance of unions protecting their members from technological displacements, and have started pushing for “requirements that companies must notify and negotiate with worker representatives before deploying new automation technologies.”[18]

The above-mentioned partnership between the AFL-CIO and Microsoft includes a “neutrality framework” which “confirms a joint commitment to respect the right of employees to form or join unions, to develop positive and cooperative labor-management relationships, and to negotiate collective bargaining agreements that will support workers in an era of rapid technological change.”[19] Ideally, this means that Microsoft would not attempt to dissuade any employees that try to unionize, including through common “union avoidance” measures.[20] Employer neutrality can provide more favorable conditions for unionizing, which provides a formal mechanism for workers to collectively bargain for technology policies calibrated to their particular industry and tasks.

Unfortunately, achieving these measures, whether through legislation or Collective Bargaining Agreements (CBAs), will likely require applying tremendous pressure on employers.

For example, in 2023, the Screen Actors Guild – American Federation of Television and Radio Artists (SAG-AFTRA) union and the Writers Guild of America (WGA) simultaneously went on strike for the first time in sixty years.[21] One of the main demands for both unions was protections against AI use. Both achieved partial concessions after 118 days and 148 days out on strike, respectively.[22]

SAG-AFTRA and WGA enjoyed considerable leverage that other workers likely will not have. As Politico reported, Hollywood serves as a “key base for wealthy Democratic donors” which is especially important in California, where much of the industry is based.[23] Entertainment workers occupy an important place in many of our daily lives and support an economically important industry.[24] Unlike healthcare workers or state employees, withholding their labor cannot be portrayed as dangerous, a characterization that seeks to undermine public support for some striking workers.[25]

The resolve and strategic action of both unions charts a path for other unions to ensure worker input into the use of technology in the workplace, while revealing how difficult this path will be.

Conclusion

Although the exact effects of increased AI-adoption by employers are still unknown, there are clear reasons to take their potential effects on workers seriously, today. Workers across the income spectrum are already feeling the pressure of job losses, job displacements, the need to retrain for a new job, and the economic and emotional stress these cause. Bolstering retraining programs, whether run by the government, employers, or through joint efforts are a step towards meeting the demands of tomorrow. However, to truly assuage employee fears of displacement, workers must have meaningful input into their working conditions, including the introduction of new technology to their workplace. Unions hold an important role in achieving this goal.

Employee Vaccine Mandates: So, Are We Doing This?

Rewind to the beginning of September. President Biden had just announced a generalized plan for addressing the alarmingly slow rise in vaccination rates in the United States. His disposition was serious as he pleaded with the American public to go out and get vaccinated. During this address he laid out several different measures that, conceivably, would lead to a higher national vaccination rate. Included in this plan was a vaccine requirement for all federal employees and government contractors. This sanction did not come as much of a surprise, as federal employees had previously been asked to provide proof of vaccination to avoid stringent safety protocols in the workplace. What was surprising, however, was President Biden’s plea to the Department of Labor to develop a federal vaccine mandate or required weekly COVID testing for private companies employing more than one hundred employees.

In the wake of this announcement came many different responses. On the one hand there were some private U.S. companies already enforcing vaccine policies who seemed unrattled by a potential new federal mandate, and there were some companies who viewed it as a welcome opportunity to implement a vaccine policy by means of a third-party enforcer. On the other hand there were companies who loathe any type of government interference in their business activity and policy implementation, and those who have been specifically opposed to a vaccine requirement and may have even made promises to their employees saying as much. Those companies who opposed a vaccine mandate, in light of this plea from President Biden, had to start making strategic decisions on how they would move forward if the Department of Labor heeded the president’s request.

The questions that came following President Biden’s address were the same regardless of the company’s personal view. Would a federal mandate be legal, would it be constitutional, and would it ever come? This uncertainty hung in the air while private companies, those with 101 employees and 5,000 employees alike, began to prepare. Draft mandatory vaccine policies were made, legal counsel was requested, and employees were advised. Now all that was left to do was wait for the Department of Labor’s cue.

Fast-forward to November. The Department of Labor’s Occupational Safety and Health Administration (OSHA) released an emergency temporary standard (ETS) in line with President Biden’s plan. The goal of this standard being “to minimize the risk of COVID-19 transmission in the workplace,” and to “protect unvaccinated employees of large workplaces.” This standard mandates that all employers with more than 100 employees, including private companies, must require their employees get vaccinated or undergo weekly COVID tests and wear face masks while at work. The standard does not apply to remote workers, workers who predominantly work outside, or employees who work without other co-workers present.

The questions that arose after the ETS was announced were similar to those asked by companies directly after President Biden’s address. Is this ETS legal, is it constitutional, and when will we have to be in compliance? The last question seems to be easily answered; all requirements except weekly testing for unvaccinated employees must be met by December 6th, 2021. The weekly testing policy for unvaccinated employees must begin by January 6th, 2022. However, the immediate onslaught of lawsuits attempting to prevent the ETS have made these straightforward dates seem somewhat arbitrary. Companies now face a unique set of issues prompting even more, new, questions. Do we actually have to be in compliance by December 5th? What effect will these lawsuits have on the ETS? Are we just supposed to wait and see?

Legally, the situation private companies face is complex. As of November 12th, the Fifth Circuit had issued and subsequently reaffirmed a stay on the standard, meaning companies did not have to comply with the mandate. At that time, the Fifth Circuit was the only court that had issued a stay, although there were lawsuits pending in eleven of the twelve circuit courts. What complicated this Fifth Circuit determination was the question of whether or not it covered all U.S. companies; if your company is based in another Circuits’ jurisdiction was this Fifth Circuit stay relevant? The current ruling enjoins OSHA from enforcing the ETS, so while the Fifth Circuit did not write on whether their holding extended outside of their jurisdiction, its practical effect was, and is, felt everywhere. So then, what comes next? How long will this stay last, and who should private companies be looking to in planning their next move?

The Fifth Circuits’ stay will last until one of two things occur. The first is multidistrict litigation, where all outstanding lawsuits brought against the ETS will be combined, and one decision will be rendered by the Circuit Court on whether or not the stay shall be enforced. The first step of this process has already begun; on Tuesday November 16th the Sixth Circuit Court was chosen via a lottery process to preside over the multidistrict litigation. The Sixth Court is based in Cincinnati, Ohio and typically leans conservative. While this proclivity does not necessarily mean that the ETS is doomed, it does suggest that President Biden may ask the Supreme Court to take over the case, preferring the Supreme Court Justices over the Sixth Circuit’s judges. This introduces the second way the stay may be addressed, by a Supreme Court ruling. This alternative can be triggered by either a plea from the federal government directly asking the Court to end the Fifth Circuits’ stay, or via an independent decision by the Supreme Court to pluck this consolidated lawsuit out the Sixth Circuits’ hands.

However, if the Supreme Court is not called upon and chooses not to pull the case up on their own, the Sixth Circuit will have the authority to either end, modify, or extend the Fifth Circuits’ current stay on the ETS. This leaves companies with a choice; will they wait and see how the Sixth Circuit, or maybe even the Supreme Court, rules on the stay? Will they wait to see if the stay is extended and the deadline for compliance is pushed back, or will they start implanting the mandate now in the event that the stay is extinguished and December 5th compliance is reinstated?

There is a chance that an extended stay will allow these companies to push off vaccine mandates. There is also a chance that the stay will be terminated before December 5th and all original compliance deadlines will be the same. Both of these alternatives are further complicated when paired with the uncertainty surrounding timing. If a company decides to run the risk and hope for an extended stay, and the Sixth Circuit court issues a retraction of the stay on December 3rd, companies may still be forced to observe the December 5th compliance date. However, if they decide to comply right now and the stay is extended, they may regret acting so quickly. In the end the mass amount of uncertainty surrounding the ETS and resulting litigation is creating many tough decisions for private employers. While the choice to comply with OSHA’s currently suspended ETS may not be mandatory right now, it’s obvious that a failure to act may put them far behind schedule for creating and implanting an effective vaccine mandate policy. That failure to act has the potential to end in high OSHA fines as well as general pushback from the public. In the end the decision on how to treat this paused ETS is up to each individual company, as will be any consequences stemming from that choice.


COVID-19 Vaccination: Pervasive Skepticism and Employer Mandates in the United States

On December 31, 2019, the COVID-19 pandemic began when the World Health Organization’s (WHO) Chinese office picked up a media statement by the Wuhan Municipal Health Commission regarding cases of “viral pneumonia.” Nearly a year later, despite the protective measures instituted on a global scale to slow the spread, COVID-19 has claimed the lives of nearly 1,500,000 people worldwide) and shows no sign of slowing down. All hope is not lost; scientists and biopharmaceutical companies have worked diligently throughout the crisis, and a large-scale vaccination release seems imminent. However, given the prevalence of anti-vaccination sentiment in the United States, it may be difficult to distribute the vaccine to enough people; employer-mandated vaccines likely offer the best chance for widespread vaccination, but the standards governing such mandates remain unclear.

Anti-Vaccination Sentiment in the US

Whether the vaccine will provide outright immunity or simply partial protection, it will regardless be a critical step toward ending the pandemic. However, vaccines are obviously only effective if people agree to get the shot, and that may prove to be a significant barrier in the United States. Vaccine doubt and anti-vaccination movements continue to grow in popularity for a variety of reasons. Social media’s unique ability to bring together like-minded individuals across the globe inevitably results in the creation of insular groups; anti-vaccine support from celebrities such as Jenny McCarthy and Jim Carrey provide a degree of validation to “regular” people who feel the same way; and general government distrust, which has sharpened considerably under the tumultuous and polarizing Trump presidency, heightens suspicions surrounding FDA testing and approval processes. Finally, as noted by Dr. Paul A. Offit, an infectious disease expert and co-inventor of a vaccine for rotavirus, “Vaccines are a victim of their own success. We have largely eliminated the memory of many diseases.”

Moreover, skepticism regarding the safety and efficacy coronavirus vaccine is not entirely unfounded. The vaccine development process typically takes a decade, whereas this one began under a year ago. A group of researchers at the Johns Hopkins Center for Health Security and the Texas State University anthropology department writes, “If poorly designed and executed, a COVID-19 vaccination campaign in the U.S. could undermine the increasingly tenuous belief in vaccines and the public health authorities that recommend them – especially among people most at risk of COVID-19 impacts.” The results of a poll conducted by Pew Research Center in September indicates the consequences of all these factors: just over half (51%) of U.S. adults definitely or probably would get a COVID-19 vaccine if it were available today—a 21% drop from 72% in May.

Employer-Mandated Vaccines

With skepticism at an all-time high, the responsibility for raising vaccination rates in the U.S. may fall to employers. The U.S. Occupational Safety and Health Administration (OSHA) allows employers to legally impose an influenza vaccine requirement on their workers, but there are several requirements and exceptions that make such a mandate more difficult to impose.

First, employees are entitled under the Americans with Disabilities Act (ADA) to request medical and disability exemptions. This exemption requires proof of an underlying disability or medical condition that renders an employee essentially unable to safely get the vaccine. Second, employees may also claim religious exemptions to avoid an employer-mandated vaccine. However, Title VII of the Civil Rights Act of 1964 states that an employee must have a “sincerely held religious belief” against vaccination. In 2020, the Third Circuit Court of Appeals held that an employee’s “holistic health lifestyle” and personal belief that vaccines are harmful were insufficient to trigger protection under the Civil Rights Act. See Brown v. Children’s Hosp. of Philadelphia, 794 Fed. Appx. 226 (3rd Cir. 2020). The court wrote, “[I]t is not sufficient merely to hold a ‘sincere opposition to vaccination’; rather, the individual must show that the ‘opposition to vaccination is a religious belief.’” Id. (citing Fallon v. Mercy Catholic Med. Ctr. of Southeast Pa., 877 F.3d 487, 490 (3rd Cir. 2017)).

There are two primary standards governing the situations in which employers may legally require vaccinations regardless of religious or medical exemptions. Title VII does not require employers to make “reasonable accommodations” for medical or religious reasons if it would pose an undue hardship, which it defines as “more than de minimis cost” to the operation of the business. The ADA standard is stricter, requiring reasonable accommodation barring undue hardship, which it defines as an “action requiring significant difficulty or expense.”

Finally, because vaccinations are “medical examinations” under the ADA, the COVID-19 vaccine would need to be deemed “job-related, consistent with business necessity or justified by a direct threat, and no broader or more intrusive than necessary.” Although the Equal Employment Opportunity Commission (EEOC), which is responsible for enforcing federal anti-discrimination laws in employment, has labeled COVID-19 as a “direct threat” to the workplace and stated that employers are allowed under the ADA to “bar an employee from physical presence in the workplace if he refuses to have his temperature taken or refuses to answer questions about whether he has COVID-19, has symptoms associated with COVID-19, or has been tested for COVID-19,” it has not yet stated whether employers will have the right to make a vaccine mandatory.

Conclusion

As such, the rights of employers to legally impose COVID-19 vaccination requirements on employees are uncertain and, absent clear direction or regulation, will likely require case-by-case analysis to determine the validity of each exemption and the corresponding hardship to business. Consequently, even if employers do have the legal right, protracted legal battles are the only remedy, and given the pervasive fear of vaccinations in today’s social climate, there are likely to be a great many of them. Meanwhile, the COVID-19 pandemic will continue to ravage the nation.
